第一章  總  則
 


為充分開(kāi)發(fā)利用境外優(yōu)質(zhì)教育培訓資源,促進(jìn)與境外培訓機構的合作共贏(yíng),推動(dòng)出國(境)培訓(以下簡(jiǎn)稱(chēng)“出國培訓”)健康有序發(fā)展,根據相關(guān)法律法規,制定本管理辦法。

本辦法中境外培訓機構是指承辦中國有關(guān)單位境外培訓項目的境外各類(lèi)機構或組織(包括外國政府機構、國際組織、非政府組織和知名大學(xué)、企業(yè)、專(zhuān)業(yè)培訓機構等)。境外培訓合作機構專(zhuān)指與國家外國專(zhuān)家局(以下簡(jiǎn)稱(chēng)國家外專(zhuān)局)建立培訓合作伙伴關(guān)系并簽訂《境外培訓合作框架協(xié)議》(附件一)的境外培訓機構。

國家外國專(zhuān)家局出國培訓管理司(以下簡(jiǎn)稱(chēng)國家外專(zhuān)局培訓司)具體負責境外培訓合作機構的開(kāi)辟、聯(lián)系協(xié)調、監督管理等工作。
 


第二章  合作原則

 


(一)質(zhì)量導向。堅持質(zhì)量第一,著(zhù)力提高出國培訓針對性和有效性,不斷深化合作內容,提升合作層次,提高出國培訓質(zhì)量和效益。

(二)平等互利。建立平等互利的合作伙伴關(guān)系,通過(guò)雙方共同努力,促進(jìn)學(xué)習借鑒、經(jīng)驗共享,積極推動(dòng)國際人才交流與合作,實(shí)現合作共贏(yíng)。

(三)誠實(shí)守信。合作雙方須嚴格遵守中國和相關(guān)國家的法律、法規,以及中國政府關(guān)于出國培訓的方針政策和有關(guān)規定,規范市場(chǎng)行為。

(四)優(yōu)勝劣汰。堅持高端化、專(zhuān)業(yè)化和規范化方向,積極開(kāi)發(fā)利用境外知名大學(xué)、企業(yè)、專(zhuān)業(yè)機構等優(yōu)質(zhì)教育培訓資源。完善合作機構退出機制,逐步構建“特長(cháng)明確、優(yōu)勢互補、布局合理、競爭有序”的境外培訓合作機構資源體系。
 


第三章  合作內容及責任

 


根據雙方平等自愿協(xié)商,國家外專(zhuān)局培訓司與境外培訓機構達成合作意向后,雙方簽訂《境外培訓合作框架協(xié)議》,建立合作伙伴關(guān)系。有關(guān)各方責任和義務(wù)如下:

(一)國家外專(zhuān)局培訓司

1.機構開(kāi)辟:重點(diǎn)發(fā)展有信譽(yù)、有能力、有經(jīng)驗、專(zhuān)業(yè)對口、對中國友好、管理規范的高層次境外培訓合作機構。

2.搭建平臺:每年年初公布年度境外培訓合作機構名單(并將實(shí)時(shí)更新),供各省區市外專(zhuān)局、各部門(mén)出國培訓歸口管理部門(mén)及培訓項目組團單位從中優(yōu)先選用,并將通過(guò)舉辦培訓項目對接洽談會(huì )等形式,搭建境外培訓合作機構與國內項目單位供需交流合作平臺。

3.監督管理:加強培訓團組境外活動(dòng)管理;建立培訓團組與境外培訓合作機構雙向評估制度;對培訓團組或學(xué)員、境外培訓合作機構、社會(huì )公眾等方面的投訴或舉報進(jìn)行調查處理,嚴肅查處違規違紀行為。由中國國際人才交流協(xié)會(huì )駐外機構負責對轄區內境外培訓合作機構進(jìn)行業(yè)務(wù)指導和監督檢查。

(二)培訓項目組團單位

1.項目報批和培訓機構選擇:負責提出年度培訓項目計劃,選擇境外培訓機構,并按規定報批。選擇名單以外的與培訓主題專(zhuān)業(yè)對口的境外國際組織、非政府組織和知名大學(xué)、企業(yè)、專(zhuān)業(yè)培訓機構等,需另行提供相關(guān)背景材料;確定參訓人員和團長(cháng),進(jìn)行預培訓并協(xié)助辦理項目審批、護照簽證、醫療保險等相關(guān)手續;對培訓團組在境外期間活動(dòng)進(jìn)行跟蹤管理。

2.項目簽約:與境外培訓機構協(xié)商制定培訓日程,提出對培訓課程和師資、對口交流訪(fǎng)問(wèn)、專(zhuān)業(yè)翻譯等方面的具體要求;與境外培訓機構簽訂培訓項目合作協(xié)議,明確雙方的責任和義務(wù)等事宜,具體內容參見(jiàn)《境外培訓項目合作協(xié)議》樣本(附件二)。

3.機構變更:不得隨意變更項目計劃中已批準或已簽訂協(xié)議的境外培訓機構,確有必要須事先報國家外專(zhuān)局培訓司批準。

(三)境外培訓合作機構

1.能力建設:突出培訓特長(cháng),提供優(yōu)質(zhì)培訓資源;承接的出國培訓項目應與所在國家(地區)優(yōu)勢領(lǐng)域相符、與培訓特長(cháng)相符。

2.項目實(shí)施:負責培訓課程設計和聯(lián)系落實(shí)行程安排、發(fā)邀請信等前期準備工作;按照國家外專(zhuān)局培訓司批準的日程安排授課、對口訪(fǎng)問(wèn)等公務(wù)活動(dòng),配備高水平的專(zhuān)業(yè)翻譯,做好生活接待服務(wù);協(xié)助加強培訓團組境外活動(dòng)管理,按時(shí)填報培訓日志,制訂突發(fā)事件應急處理預案,發(fā)生重大突發(fā)事件及時(shí)報告組團單位及國家外專(zhuān)局培訓司。

3.相關(guān)義務(wù):境外培訓合作機構應主動(dòng)接受中國駐所在國使領(lǐng)館、國家外專(zhuān)局培訓司及中國國際人才交流協(xié)會(huì )駐外機構的業(yè)務(wù)指導和監督檢查,積極配合中方根據工作需要對選定的培訓團組進(jìn)行境外活動(dòng)確認、跟團培訓和抽查;境外培訓合作機構對團組培訓情況、學(xué)員個(gè)人信息或其他敏感信息有保密義務(wù),應采取相應保密措施,防止信息泄露、濫用;不得擅自使用“國家外國專(zhuān)家局認定境外培訓機構”等類(lèi)似名稱(chēng)、標識用于各種宣傳目的。
 


第四章  合作機構條件

 


境外培訓合作機構應具備的基本條件:

(一)按所在國(地區)法律依法組建,正式注冊并具有法人地位;對中國友好,不附加任何政治條件;有一定的經(jīng)濟實(shí)力與良好的資信。

(二)專(zhuān)業(yè)特色突出,有高水平的授課人員、培訓教材及專(zhuān)業(yè)翻譯人員;在所在國(地區)有較強的協(xié)辦單位網(wǎng)絡(luò ),能根據培訓項目要求,安排赴對口的機構、企業(yè)及組織等進(jìn)行交流訪(fǎng)問(wèn)。

(三)有接待中國培訓團組的服務(wù)能力,能根據與組團單位簽訂的協(xié)議提供較好的住宿、伙食、交通等方面的設施與便利。

(四)收費合理,各項收費符合有關(guān)規定。不搞有損培訓質(zhì)量的惡性?xún)r(jià)格競爭。
 


第五章  合作機構評估及簽約

 


境外培訓合作機構評估及簽約程序:

(一)有合作意向的境外培訓機構填寫(xiě)《境外培訓機構信息表》(附件三),將信息表及有關(guān)材料報中國國際人才交流協(xié)會(huì )駐外機構(所在國沒(méi)有駐外機構的,直接報國家外專(zhuān)局培訓司),注明聯(lián)系人和聯(lián)系方式。

(二)收到境外培訓機構提交的《境外培訓機構信息表》及有關(guān)材料后,中國國際人才交流協(xié)會(huì )駐外機構進(jìn)行實(shí)地考察與資信調查,出具推薦意見(jiàn)函(所在國沒(méi)有駐外代表處的,通過(guò)其他渠道調查了解)。

(三)征求中國駐當地使領(lǐng)館的意見(jiàn),由使領(lǐng)館出具推薦意見(jiàn)函。

(四)國家外專(zhuān)局每年年底組織評估,確定新的境外培訓合作機構。由國家外專(zhuān)局培訓司與境外培訓機構簽署《境外培訓合作框架協(xié)議》,有效期為五年。協(xié)議到期后,經(jīng)雙方協(xié)商同意可續簽協(xié)議。

(五)簽約或續簽協(xié)議前,雙方一般應安排法人代表或主要負責人訪(fǎng)問(wèn)對方單位或實(shí)現互訪(fǎng),明確中國政府關(guān)于出國培訓有關(guān)政策規定、重點(diǎn)合作領(lǐng)域、合作機構培訓特長(cháng)等。

(六)解除合作關(guān)系的境外機構再次提出合作意向時(shí),按上述程序重新申請。

(七)合作機構重要信息變更需提供機構法人或負責人確認函件,并提交《境外培訓合作機構信息變更申請表》(附件四),必要時(shí)需請駐外使領(lǐng)館或中國國際人才交流協(xié)會(huì )駐外機構出具證明函件。
 


第六章  質(zhì)量評估及年度報告

 


建立培訓團組與境外培訓機構雙向評估制度。每個(gè)培訓團組完成任務(wù)回國后,除按要求提交團組培訓總結和按規定核銷(xiāo)相關(guān)費用外,要對培訓課程設置、師資水平、專(zhuān)業(yè)翻譯、對口交流訪(fǎng)問(wèn)、達到預期培訓目的程度等方面進(jìn)行評價(jià);境外培訓機構對團組學(xué)習態(tài)度、培訓和業(yè)務(wù)交流表現、執行批準日程等方面進(jìn)行評價(jià)。

每年年底前,境外培訓合作機構應向國家外專(zhuān)局培訓司提交年度培訓合作總結報告并抄送中國國際人才交流協(xié)會(huì )駐外機構,內容包括承辦中國培訓團組總體規模,課堂授課、對口交流訪(fǎng)問(wèn)或業(yè)務(wù)實(shí)踐、生活接待服務(wù)、培訓設施和能力建設等有關(guān)情況,圍繞培訓特長(cháng)所安排重點(diǎn)團組培訓案例,在聯(lián)系協(xié)調、邀請、培訓日程安排、安全、違規違紀等方面發(fā)生的問(wèn)題以及對培訓工作的意見(jiàn)和建議等。

國家外專(zhuān)局培訓司將根據培訓團組的評價(jià)和合作機構提交的年度培訓合作總結報告,結合駐外使領(lǐng)館、中國國際人才交流協(xié)會(huì )駐外機構、各省區市外國專(zhuān)家局和國務(wù)院各部門(mén)、直屬機構出國培訓歸口管理部門(mén)反饋的意見(jiàn)、在項目審批及執行過(guò)程中發(fā)現的違規違紀問(wèn)題等方面情況,對境外培訓合作機構進(jìn)行綜合評估。
 


第七章  合作的中止或解除
 


(一)因不可抗力或其他原因,在《境外培訓合作框架協(xié)議》到期前,任何一方均可提出中止或解除合作關(guān)系,需提前二個(gè)月通知另一方。

(二)境外培訓合作機構連續兩年不提交年度培訓合作總結報告,將暫停合作協(xié)議的執行;連續三年不提交的,將按自動(dòng)退出處理,解除合作關(guān)系。對綜合評估結果較差的機構,國家外專(zhuān)局培訓司將通知對方暫停合作協(xié)議的執行或解除合作關(guān)系。

(三)經(jīng)調查核實(shí),境外培訓機構在承辦培訓中出現以下問(wèn)題的,將視其問(wèn)題的性質(zhì)與情節嚴重程度等,對境外培訓合作機構進(jìn)行暫停承辦培訓項目、暫停合作協(xié)議的執行、解除合作關(guān)系等處理;對非簽約境外培訓機構,將列入境外培訓禁入機構名單并通報處理,限制或禁止其接待出國(境)培訓團組。相關(guān)處理結果將在國家外國專(zhuān)家局政府網(wǎng)站上公布,如有異議,須在30天內向國家外專(zhuān)局培訓司提出書(shū)面申訴。

1.境外培訓機構提供虛假邀請函、虛假培訓日程及經(jīng)費預算、發(fā)票等的;

2.采取惡性低價(jià)競爭、回扣等不正當手段或以降低培訓質(zhì)量等方式招攬出國(境)培訓團組的;假冒其它培訓機構名義或同意其它機構以其名義承辦培訓的;轉手其他機構、中介或旅行社接待培訓團組的;

3.擅自更改已批準的培訓日程,實(shí)際執行培訓日程與報批日程嚴重不符的;組織或有工作人員協(xié)助出國(境)培訓團組或個(gè)人到未經(jīng)批準進(jìn)行培訓活動(dòng)的國家(地區)或城市、到境外色情或賭博場(chǎng)所、用公款出國(境)旅游的;

4.未能配合完成培訓日志填報等境外監管工作的;

5.境外期間因境外培訓機構管理不善等原因發(fā)生重大人身傷亡、交通事故或財產(chǎn)損失的;

6.培訓團組強烈反映,培訓質(zhì)量、服務(wù)質(zhì)量出現問(wèn)題或造成較大社會(huì )影響的;

7.發(fā)生其他影響培訓質(zhì)量及培訓聲譽(yù)的不良行為。
 


第八章  附則
 


本管理辦法自發(fā)布之日起實(shí)行?!秶ň常┩馀嘤柷拦芾頃盒修k法》(外專(zhuān)發(fā)〔1999〕4號)、《國(境)外培訓渠道管理暫行辦法實(shí)施細則》(外專(zhuān)發(fā)〔1999〕88號)同時(shí)廢止。

本管理辦法由國家外專(zhuān)局培訓司負責解釋。

Provisional Regulations for Management of Overseas Training Cooperative Organizations


 


ChapterⅠGeneral Principles

 


Based on relevant laws and regulations, in order to fully develop and utilize high-qualified overseas education and training resources, promote the win-win cooperation with overseas training organizations and further healthy and orderly development of overseas and outbound training (hereinafter referred to as "overseas training"), the Regulations for Management of Overseas Training Cooperative Organizations is formulated.

In the Regulations, Overseas Training Organizations (OTO) refers to all types of institutions or organizations abroad undertaking overseas training programs for Chinese departments (including foreign government agencies, international organizations, non-governmental organizations and international prestigious universities, enterprises, professional training institutions, etc.). Overseas Training Cooperative Organizations (OTCO) refers to the OTO establishing training cooperative partnership and signing "Overseas Training Cooperation Framework Agreement" (Annex I) with the State Administration of Foreign Experts Affairs (hereinafter referred to as "SAFEA").

The Department of Overseas Training of the State Administration of Foreign Experts Affairs (hereinafter referred to as “the Department of Overseas Training of SAFEA") is responsible for the development, coordination, supervision and management of overseas training cooperation organizations.
 


ChapterⅡ Principles of Cooperation


1. Quality-oriented. The cooperation should hold the ideals of top quality as the priority. Efforts should be made toward strengthening the target-orientation and effectiveness of overseas training, deepening cooperation contents and enhancing the level of cooperation with an aim to improve the quality and benefit of overseas training.

2. Equality and Mutual Benefit. The cooperation should be based on equal and mutually beneficial partnerships. Through concerted efforts, both sides can learn from each other, share experiences and actively promote international exchanges and cooperation of human resources in order to achieve a win-win cooperation.

3. Integrity. The cooperation should strictly abide by the laws and regulations of China and related countries as well as the policies and regulations of the Chinese government on overseas training to regulate the market.

4. Optimal Selection. The cooperation should follow the orientation of high level professionalism and normalisation. Focus must be made on exploring and utilizing high-quality education and training resources including international prestigious universities, enterprises and professional organizations. The cooperative organization exit mechanism should be improved. We aim to build an OTCO resource system featured with "specific strengths, complementary advantages, rational structure and orderly competition".
 


Chapter III Contents and Responsibilities of Cooperation
 


On the principle of equal and voluntary consultation, the Department of Overseas Training of SAFEA and OTO will sign Overseas Training Cooperative Framework Agreement and establish the training cooperative partnership. Related responsibilities and obligations come as follows.

1. Department of Overseas Training of SAFEA

a. Development of Organizations. Focus should be made on the development of high-level OTCO like those with a good reputation, high qualifications, rich experiences, matching strengths, friendly to China and having good management.

b. Building of the Platform. At the beginning of every year, an annual book of Overseas Training Cooperative Organizations will be published (and will also be updated in real time the list of OTCO). It is used to choose the suitable organization by bureaus of foreign experts affairs at all levels as well as foreign affairs departments for administration of overseas training and units for training programs. A platform will be built for exchanges and cooperation between OTCO and domestic units for meeting the need of overseas training through a periodically-staged program fair and other forms.

c. Supervision and Management. The Department of Overseas Training of SAFEA should enhance the management of overseas training activities, build two-way evaluation mechanisms of both training groups and OTCO, investigate and settle complaints or reports from training groups, trainees, OTCO and the public, and severely punish all acts of violation of regulations and disciplines. The overseas representative offices of China Association of International Exchange of Personnel (hereinafter referred to as “CAIEP”) are responsible for work guidance, supervision and inspection of the OTCO within their jurisdiction.

2. Units for Training Programs

a. Application of Training Programs and Choice of Training Organizations.  Units for training programs are responsible for making their annual training program plans, selecting the OTO and reporting to the administration for approval. If the selected OTO are overseas international organizations, NGOs, international prestigious universities, enterprises and training institutions suitable to the training theme but not on the annual book of OTCO, relevant background materials should be provided. Units must select qualified trainees and appoint the group leaders. It is the duty to conduct the pre-training program, report the program application, go through passports, visas, health insurance and related formalities, and take charge of the activities of the training groups abroad.

b. Signing of Program Contracts. Units should consult with the OTO to design training schedules together and set specific requirements for training curriculum, teachers, visits and interpreters, etc. A cooperative training agreement must be signed with the OTO to clarify the responsibilities and obligations of both parties. Specific details are available on the sample of Overseas Training Program Cooperation Agreement (Annex II).

c. Change of Organizations. The approved or contracted OTO are not allowed to change/replace any element randomly. If needed, units for training programs should report to the Department of Overseas Training of SAFEA and get permission for recommended changes.

3. OTCO

a. Building of Capacity. OTCO should highlight training expertise and provide quality training resources. The overseas training program should match the advantages of the host countries (regions) and the training expertise of the OTCO.

b. Implementation of Programs. OTCO are responsible for design of training curriculum and itinerary, invitation letters and other preparatory work. Training lectures, visits and other official activities should be detailed in the edition approved by the Department of Overseas Training of SAFEA. High-qualified interpreters and top-quality services are required. It is OTCO's duty to assist the training groups with management of overseas activities and reporting training log timely, make emergency response plans and report to units for training programs and the Department of Overseas Training of SAFEA at the first time if major emergencies occur.

c. Related Obligations. OTCO should accept the work guidance and supervision of China's embassies and consulates in host countries, the Department of Overseas Training of SAFEA and overseas representative offices of CAIEP. Moreover, OTCO should actively cooperate with the Chinese side to confirm overseas training activities, participate in training and perform surveys on designated training groups. It is the duty to safeguard the documents of training, trainees and other sensitive information and take security measures to prevent any leakage and abuse of confidential information. Without permission, OTCO are not allowed to use “OTO Accredited by SAFEA” or other similar names and logos for publicity.

 

Chapter IV Requirements for Qualified Overseas Training Cooperative Organizations
 


OTCO should meet the following basic requirements:

1. OTCO should be officially registered to establish legal person status in accordance with the laws of the countries (regions) in which they are located. They should be friendly to China without any political requirements. And they must have a good financial foundation and reputation.

2. OTCO should have prominent professional features with high-qualified teachers, training materials, textbooks and interpreters. They should have a fairly strong network of cooperative agencies in the countries (regions) in which they are located and are able to arrange exchange visits to matching departments, enterprises and organizations in line with the requirements of training programs.

3. OTCO must be able to provide good services for Chinese training groups including suitable accommodation, board and transportation based on the agreements signed with the training groups.

4. All training services should be provided at reasonable prices. The training prices must correspond with the relevant regulations. Any unfair competitive practices, which do harm to the training quality, are prohibited.
 


Chapter V Evaluation and Agreement with OTCO

 


The evaluation and agreement-signing procedures with OTCO:

1. OTO, with cooperative orientation, can fill in the Overseas Training Organization Information Form (see Annex III) and submit the completed form and relevant materials to the overseas representative offices of CAIEP (for those without representative offices at-hand, please send them directly to the Department of Overseas Training of SAFEA). Contact person and contact information are also needed.

2. After receiving the Overseas Training Organization Information Form and relevant materials, based on site visits and credit investigation, the overseas representative offices of CAIEP will write a letter of recommendation (for those without representative offices at-hand, related investigations should be made by other methods).

3. The opinions of the local Chinese embassies and consulates should be collected and they will write a letter of recommendation.

4. At the end of every year, SAFEA will confirm new applicants of OTCO based on formal evaluations. The Department of Overseas Training of SAFEA will sign Overseas Training Cooperation Framework Agreement with the OTCO with a five-year term. If both parties agree, the agreement can be renewed after expiration.

5. Before signing or renewing an agreement, legal representatives or chief leaders from each party should exchange visits to learn details of the overseas training policies of the Chinese government, key cooperative areas and training strengths of OTCO, etc.

6. If OTCO's cooperation with SAFEA has been suspended but they want to renew the cooperation, they should submit their application again according to the above procedures.

7. If OTCO's significant information needs to be updated, the OTCO should provide authorized documents from legal representatives or chief leaders and Application Form for Information Change of OTCO (Annex IV). If needed, the local Chinese embassies and consulates or overseas representative offices of CAIEP will issue confirmed documents.
 


Chapter VI Quality Evaluation and Annual Report

 


A two-way evaluation system should be established between training groups and overseas training organizations. After overseas training, in addition to submission of a training summary and reimbursement for related fees, groups are required to give an evaluation report reviewing the courses, quality of teachers and interpreters, effect of visits, realization of expected targets and the others, Meanwhile, overseas training organizations will provide feedback and an evaluation report on learning attitudes of participants, notes on performance during the training and exchange activities and implementation of the approved itinerary of the training group.

At the end of every year, OTCO should submit an annual summary report on training cooperation to the Department of Overseas Training of SAFEA and copy it to the overseas representative offices of CAIEP. The report should include a review of overall size of the Chinese training groups, courses, visits or business practices, accommodation, training facilities and capacity-building methods, etc. Based on training cases of key groups, OTCO should report the true situation of coordination, invitation, itinerary, security and any violation of regulations and disciplines, etc. Opinions and suggestions should be also included.

The Department of Overseas Training of SAFEA will conduct a comprehensive evaluation on OTCO based on the evaluation forms submitted by training groups, the annual cooperative training summary reports submitted by OTCO and the opinions collected from Chinese embassies and consulates, overseas representative offices of CAIEP, administrations of foreign experts affairs at all levels and overseas training departments of ministries of the State Council. Any violation of regulations and disciplines found during program approval and implementation must be also reported.
 


Chapter VII Suspension or Termination of Cooperation
 


1. Due to force majeure or other reasons, either party may suspend or terminate the cooperative relationship before the expiration of the Overseas Training Cooperation Framework Agreement, but with a notice to the other party provided at least two months in advance.

2. If the OTCO fails to submit their annual cooperative training summary reports for two consecutive years, the cooperation agreement will be suspended. If the OTCO fails to submit the reports for three consecutive years, the cooperation agreement will be terminated automatically. If the OTCO receives a poor comprehensive evaluation, the Department of Overseas Training of SAFEA will give a notice to the OTCO of intent to suspend or terminate their cooperative agreement.

3. Based on investigation and verification, the Department of Overseas Training of SAFEA will suspend the training programs, suspend the cooperative agreement and terminate the cooperative relationship accordingly if the OTCO is found to have the following problems. As for the OTO without signing the cooperative agreement, the Department of Overseas Training of SAFEA will put the OTO in the banned list of overseas training and publicize it. The OTO will be limited or prohibited from receiving overseas training groups. The results will be also publicized on the website of SAFEA. If any disagreement arises, written complaints should be submitted to the Department of Overseas Training of SAFEA within 30 days of occurrence.

a. Issuing fake invitations, fake training itinerary, false budget and invoices, etc.

b. Attempting to attract overseas training groups by undertaking vicious price competition, kickbacks or other improper means that are judged to reduce the quality of training. Using the name of other training agencies to conduct training or allowing other training organizations to undertake its own training programs. And transferring the training groups to other organizations, agents or travel agencies.

c. Changing the approved training itinerary without permission and the real itinerary to be significantly different from the approved one. Organizing or assisting the training groups or individuals to go to other countries (regions) or cities without prior approval, or to sites featuring pornography or gambling and for personal travel using the government funds.

d. Those organizations that failed to complete the overseas supervision work including coordinating filling training log.

e. Due to poor management of OTO/OTCO, causing heavy casualties, traffic accidents or property damages during the overseas training.

f. Receiving complaints from the training groups on quality of training or related services or causing severe social impacts.

g. Others producing a negative effect on quality of training and reputation.
 


Chapter VIII Supplementary



The Regulations takes effect as of the date of release. The Provisional Regulations for Management of Overseas Training Agencies (SAFEA 1999 No.4) and the Provisional Rules for the Implementation on Management of Overseas Training Agencies (SAFEA 1999 No. 88) will be terminated simultaneously.

The Department of Overseas Training of SAFEA is responsible for interpretation of the Regulations.
